General Terms and Conditions (GTC) – NatureWatt GmbH (CH & LI)

(valid for orders via www.naturewatt.ch – as of 10/2025)


1. Scope

1.1. These General Terms and Conditions (GTC) apply to all orders placed by customers with residence or registered office in Switzerland (CH) and in the Principality of Liechtenstein (LI) via the online shop www.naturewatt.ch of NatureWatt GmbH (Germany).

1.2. A consumer is any natural person who concludes a legal transaction for private purposes that cannot be attributed to their commercial or self-employed professional activity. An entrepreneur is any natural or legal person or partnership with legal capacity acting in the course of their commercial or self-employed professional activity.

1.3. Conflicting or supplementary terms and conditions of the customer are not recognized unless expressly confirmed in writing by NatureWatt GmbH.

2. Contracting Party and Conclusion of Contract

(CH) NatureWatt GmbH acts as importer. Due to the current annual turnover being below the Swiss VAT registration threshold, there is presently no obligation to register for VAT; voluntary registration remains reserved.
(LI) Analogously in Liechtenstein: NatureWatt GmbH handles import and the settlement of customs/duties. VAT registration is voluntary in the case of low turnover, otherwise required in accordance with EEA law.

2.2. The presentation of products on naturewatt.ch does not constitute a legally binding offer but an invitation to place an order. The contract is concluded only by explicit order confirmation or by dispatch of the goods.

2.3. Orders can be placed only via the online shop.

3. Prices

3.1. All prices are stated in Swiss francs (CHF) and are final prices incl. statutory VAT (if applicable), customs duties, import costs and handling (DDP according to Incoterms® 2020).

3.2. Price changes and errors are reserved; the contract price is determined by the order confirmation.

3.3. Shipping costs are shown separately during the ordering process.

4. Delivery

4.1. Delivery is made DDP (Delivered Duty Paid) to the address specified by the customer in Switzerland or Liechtenstein.

4.2. Delivery times are indicated in the online shop. Minor deviations do not entitle the customer to withdraw.

4.3. In the event of delivery delay, NatureWatt GmbH is liable only for intent or gross negligence.

4.4. Transfer of risk:
(CH) In accordance with Art. 185 CO, the risk passes to the buyer upon handover of the goods.
(LI) Accordingly, Art. 1053 PGR.

5. Payment

5.1. The payment methods indicated in the online shop apply (advance payment, PayPal, credit card via Stripe).

5.2. Payment is made in CHF. The invoice amount is due immediately upon conclusion of the contract.

5.3. Title to the goods remains with NatureWatt GmbH until payment has been made in full (see section 8).

6. Non-Performance / Failure to Take Delivery

6.1. If the customer fails to take delivery of the goods without justified reason, NatureWatt GmbH may claim reasonable compensation.

6.2. This amounts to a lump sum of 20% of the value of the goods unless the customer proves lesser damage.

(CH/LI) In accordance with Art. 97 CO / Art. 1003 PGR (damages for non-performance).

7. Return and Right of Withdrawal for Consumers (CH / LI)

7.1 Switzerland – Voluntary Contractual Right of Return (CH)
Consumers resident in Switzerland are granted by NatureWatt GmbH a contractual right of return of 14 days from receipt of the goods. Within this period, you may withdraw from the purchase contract by returning the goods to us within 14 days of receipt. Timely dispatch (postmark or handover to the parcel service) is sufficient to meet the deadline.

Conditions for return:
The goods must be returned complete, undamaged and in the original packaging. Please enclose a copy of the invoice or a note with the order number so that allocation is possible.

Return shipping costs:
Return shipment is at your cost and risk, unless the goods delivered were defective or incorrect; in such case we bear the costs. We recommend sending the return insured and with tracking.

Refund:
After receipt and inspection of the return, we refund the purchase price (including any Swiss VAT paid) within 14 days to the account or payment method used for payment. Outbound shipping costs are not refunded, except that in the case of returning the entire order the cheapest shipping method is refunded. We reserve the right to deduct any decrease in value caused by improper handling from the refund amount.

Exclusion of the right of return:
The right of return does not apply to goods made to customer specifications or clearly tailored to personal needs (custom-made products), goods that are sealed and are not suitable for return for reasons of health protection or hygiene if their seal has been removed, or software or data carriers where the seal has been removed. This voluntary right of return does not affect your statutory warranty rights (see section 9).

7.2 Liechtenstein – Statutory Right of Withdrawal (FAGG) (LI)
Consumers resident in Liechtenstein have a statutory right of withdrawal of 14 days pursuant to the Distance and Off-Premises Contracts Act (FAGG, LGBl. 2016 No. 43).

Withdrawal period:
The period is 14 days from the day on which you or a third party named by you (who is not the carrier) have taken possession of the goods.

by means of a clear declaration (e.g. letter or e-mail) of your decision to withdraw from this contract. You may use the model withdrawal form available on our website, which is not mandatory. Timely dispatch of the declaration is sufficient to meet the deadline.

Effects of withdrawal:
If you withdraw from this contract, we will reimburse all payments, including delivery costs (except for additional costs resulting from a delivery method chosen by you that is not the standard method offered), without undue delay and at the latest within 14 days of receipt of your notice of withdrawal. We use the same means of payment as used in the original transaction; no fees arise for the refund. We may withhold the refund until we have received the goods back or you have provided proof that you have sent them back.

Return of goods:
You must send back or hand over the goods without undue delay and in any event no later than 14 days from the day on which you notified us of your withdrawal, to the return address stated on the invoice. The deadline is met if you dispatch the goods before the 14-day period has expired. You bear the direct costs of returning the goods, provided you were informed of this before conclusion of the contract.

Diminution in value:
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exceptions to the right of withdrawal:
The right of withdrawal does not apply to distance contracts for goods made to customer specifications or clearly tailored to personal needs, goods that are not suitable for return for hygiene or health protection reasons and whose seal has been removed after delivery, goods that are liable to deteriorate rapidly or whose expiry date would be quickly exceeded, as well as in the other statutory exceptions pursuant to Art. 30 FAGG.

Note: This withdrawal information complies with the information obligations under Annex I FAGG and Directive 2011/83/EU.

8. Retention of Title

8.1. Delivered goods remain the property of NatureWatt GmbH until payment has been made in full.

8.2. (CH) NatureWatt GmbH is entitled to have the retention of title entered in the retention of title register in accordance with Art. 715 CC.

8.3. (LI) In accordance with Art. 215 PGR, a retention of title may be entered in the public register.

9. Warranty and Guarantee

9.1. Statutory warranty:
(CH) The provisions of the Swiss Code of Obligations (Art. 197 et seq. CO) apply: the buyer is entitled to rescission or reduction.
(LI) Accordingly, Art. 1052 et seq. PGR: rescission, reduction or replacement delivery.

9.2. Guarantee / Manufacturer’s guarantee: Where a guarantee is granted in addition to the statutory warranty, the conditions of the respective manufacturer (e.g. Victron) apply.

9.3. Exclusions: Normal wear and tear, improper handling or use not in accordance with the intended purpose are excluded from the warranty.

10. Liability

10.1. NatureWatt GmbH is liable without limitation for damage resulting from intent or gross negligence, as well as for injury to life, body or health.

10.2. In the case of slight negligence, liability exists only for the breach of essential contractual obligations (cardinal obligations).

10.3. Liability for indirect or consequential damages is excluded.

10.4. (CH/LI) Liability under the Product Liability Act (PrHG) remains unaffected.

11. Product Safety and Conformity

All products delivered by NatureWatt GmbH to Switzerland and Liechtenstein meet the applicable legal requirements regarding safety, electromagnetic compatibility and product liability. They are CE-compliant and comply with the relevant Swiss and European standards.

12. Data Protection

12.1. Personal data are processed in accordance with the applicable data protection provisions:
(CH) Federal Act on Data Protection (FADP, SR 235.1).
(LI) Data Protection Act (DSG-LI) and General Data Protection Regulation (GDPR, EEA implementation).

12.2. Payment processing via Stripe or PayPal may involve data transfers to third countries; such transfers are carried out in accordance with recognized standard contractual clauses.

13. Applicable Law and Place of Jurisdiction

13.1. Consumers:
(CH) For consumers resident in Switzerland, Swiss law applies exclusively; the place of jurisdiction is the consumer’s domicile (Art. 32 CPC).
(LI) For consumers resident in Liechtenstein, Liechtenstein law applies; the place of jurisdiction is Vaduz or the consumer’s domicile.

13.2. Entrepreneurs: For business customers (B2B), German law applies; the place of jurisdiction is the registered office of NatureWatt GmbH.

14. Severability

If any provision of these GTC is invalid, the remaining provisions shall not be affected.

15. Amendments to the GTC

NatureWatt GmbH reserves the right to amend these GTC at any time. Amendments are published on the website and apply from publication to new contracts.

In case of discrepancies or inconsistencies, the German version shall prevail.
